At New Case Pty Ltd, we sell phone cases and accessories designed to help protect mobile phones from everyday use, including bumps, scratches, dust and minor impacts.
However, no phone case, screen protector or accessory can guarantee that a phone or device will not be damaged in every situation. Damage can still occur depending on the circumstances of the drop, impact or accident.
No Guarantee Against Phone Damage
Our protective cases are supplied as phone accessories only. They do not provide phone insurance and they do not guarantee that a phone, screen, camera lens, back glass, frame or internal component will not be damaged.
The level of protection may vary depending on factors including, but not limited to:
- The height of the drop
- The angle of impact
- The surface the phone lands on
- Whether a screen protector is fitted
- Whether the case is installed correctly
- The existing condition of the phone
- Whether the phone is already cracked, bent, weakened or previously repaired
- Whether the phone is exposed to crushing, bending, pressure, water or extreme force
Customer Responsibility
Customers are responsible for checking that the correct case model has been selected for their phone before purchase. A case designed for one phone model may not fit or protect another model correctly.
Customers should also check that the case is fitted correctly before use and should regularly inspect the case for signs of wear, damage or incorrect fitment.
Screen Protectors Recommended
For best protection, we recommend using a suitable tempered glass screen protector together with a protective case. A phone case alone may not protect the front screen, camera lens or other exposed areas from all types of damage.
Limitation Regarding Device Damage
To the extent permitted by law, New Case Pty Ltd is not responsible for damage to phones, tablets or other devices while using our products. This includes, but is not limited to, screen damage, camera damage, back glass damage, frame damage, internal damage, water damage or accidental damage.
Our products are protective accessories only and are not a replacement for phone insurance or careful handling.
Australian Consumer Law
Nothing in this disclaimer excludes, restricts or modifies any rights you may have under the Australian Consumer Law.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
